The concept of equality between men and women has spurred debates both nationally and internationally over the years. This has seen the enactment of international human rights instruments with anti-discriminatory provisions and more so, a convention entirely dedicated to protecting women against any form of discrimination, that is, Convention on the Elimination of all forms of Discrimination against Women (CEDAW).This study looks into protection of women’s rights to matrimonial property upon the dissolution of a marriage. The starting point of the study is the family, and particularly what marriage means for women as regards property rights. As the study concerns matrimonial property laws in Kenya, the research mainly reviews prior and existing laws in Kenya.Using a feministic approach, the study examines whether women’s rights to matrimonial property are adequately protected by the relevant statutory provisions in Kenya.en_US
