Abstract
Approval and licensing of buildings is an important aspect of building regulations, by virtue of which developers, project planners and licensing authorities can be held liable for substandard buildings. haphazard developments and unauthorized structures that are leading to the loss of lives of many people and massive destruction of property. Regardless of the robust laws and policies that have been enacted to regulate urban planning and evaluate development projects, Kenyan urban areas, and more specifically Nairobi, still faces a myriad of issues concerning poor urban planning and frequent collapsing of buildings. This study aims to look into the current legal framework governing approvals and licensing of buildings in Kenya, and to examine the effectiveness or lack thereof of the enforcement mechanisms undertaken to effectuate such approvals and licensing of developments, as well as to investigate the factors that contribute to the challenges in implementing the licensing and approval of buildings as established by law
